In Nevada: none. Psilocybin is a Schedule I drug under state and federal law.
Is it legal to have magic mushrooms in Las Vegas?
No. Nevada lists psilocybin and psilocin, the active compounds in magic mushrooms, in Schedule I, its most restricted category1. Having any amount is a felony under state law2, and psilocybin is Schedule I under federal law too3.
That's true on the Strip, downtown, in Henderson and everywhere else in the state. Nevada's 2023 attempt to decriminalize mushrooms was cut down to a study group before it passed, and a 2025 bill for a supervised pilot program never became law45. Our Nevada psilocybin law tracker has the full history.
What do the "mushroom" shops on the Strip sell?
Not legal psilocybin, because there's no such thing for sale in Nevada. Cannabis dispensaries are licensed for cannabis, and no Nevada license covers psilocybin. Products sold as "mushroom" gummies, chocolates or "legal shrooms" in smoke shops and gift stores aren't licensed psilocybin either, and federal regulators have found Amanita muscaria compounds and unlisted drugs in some of them67.
The risk is real. When the FDA tested Diamond Shruumz bars, cones and gummies in 2024, it found muscimol in some samples and, in others, psilocin, a synthetic called 4-AcO-DMT (acetylpsilocin), the prescription drug pregabalin and kava compounds. The investigation counted 180 illnesses in 34 states, two of them in Nevada (118 of the 180 people reported eating Diamond Shruumz products; the rest ate other or unidentified brands of mushroom chocolate), and the FDA's October 2024 list of stores that carried the recalled products had 40 Nevada rows, 29 of them in Las Vegas6. In December 2024 the FDA said Amanita muscaria, its extracts and three of its compounds (muscimol, ibotenic acid and muscarine) are not authorized as ingredients in conventional food7.
Local rules are tightening too. In March 2026 the Clark County Commission, which governs the unincorporated county that includes the Strip, adopted hemp-store rules, effective July 15, 2026, that bar those stores from selling "any products that are intended to cause an intoxicating, narcotic, and/or hallucinogenic effect"16.

Where is psilocybin legal nearest Las Vegas?
Two states run licensed programs where adults take psilocybin under supervision, on site. Colorado has 47 approved healing centers, the nearest in Durango, 537 miles from the Strip by road. Oregon's public list shows 20 service centers, the nearest two in Ashland, 724 miles away89. New Mexico's medical program hasn't opened yet; the state health department is aiming to enroll its first patients by December 31, 202610.
Nothing obtained in those programs can be carried back into Nevada. Bringing psilocybin across a state line is still a federal and Nevada crime. Our list of every licensed center by distance covers each program's rules for visitors.
What happens if you're caught with mushrooms in Nevada?
Nevada sorts possession by the weight involved and by your record. For Schedule I drugs such as psilocybin, NRS 453.336 sets these tiers2, and NRS 193.130 sets the prison ranges for each felony category11:
| Amount and record | Charge | Possible sentence |
|---|---|---|
| Under 14 grams, first or second offense | Category E felony | 1 to 4 years and a fine of up to $5,000; the court must defer judgment if the person consents |
| Under 14 grams, third or later offense | Category D felony | 1 to 4 years and a fine of up to $20,000 |
| 14 to under 28 grams | Category C felony | 1 to 5 years and a fine of up to $10,000 |
| 28 to under 42 grams | Category B felony | 1 to 10 years and a fine of up to $50,000 |
| 42 to under 100 grams | Category B felony | 2 to 15 years and a fine of up to $50,000 |
Larger amounts are charged as trafficking, and selling or giving it to someone else is charged separately. For any of these possession tiers, the statute lets the court grant probation or suspend the sentence2. The deferral for small amounts comes after a guilty or no-contest plea, isn't available to people with certain prior convictions, such as violent or sexual offenses, and means the case is dismissed if the person completes the conditions the court sets17; it's still an arrest and a felony charge. This is a summary of the statute, not legal advice; anyone facing a charge should talk to a Nevada criminal defense lawyer. The law tracker covers trafficking, driving and the open questions about how mushroom weight is counted.
Visiting? The same law applies on the Strip
Hotels, casinos and the Strip are all under Nevada law, and Red Rock Canyon and Lake Mead are federal land, where federal drug law applies directly. Harry Reid International Airport is screened by the federal TSA. Driving under the influence of a controlled substance is illegal in Nevada18. Our guide for visitors goes through each.
Staying safe: heat, mixing and when to call 911
Psilocybin doesn't mix safely with everything. Oregon's licensed program turns away anyone who has taken lithium in the last 30 days or has ever been diagnosed with or treated for active psychosis20, and many psilocybin trials exclude people with bipolar disorder or who take certain antidepressants21. Alcohol adds to dehydration in the heat12. If a friend is frightened or confused, stay with them somewhere cool and quiet, and call for help if anything looks medical. The Fireside Project's peer support line takes calls and texts at 62-FIRESIDE (623-473-7433) from 11 a.m. to 11 p.m. Pacific13. Our help page lists every number, and our festival and heat guide covers EDC and Burning Man.
Could psilocybin become legal in Nevada?
Possibly, by prescription first. Compass Pathways told investors in August 2026 that it expects to complete its FDA application for its psilocybin treatment in the fourth quarter of 2026, with a commercial launch expected in the first half of 2027, subject to FDA approval and following DEA rescheduling14. An approved product would still need to be rescheduled federally, and a Nevada statute, NRS 453.2182, makes the state's Board of Pharmacy follow a federal rescheduling 60 days after the final order is published in the Federal Register, unless the Board or an interested party objects within that time15. That would likely cover the approved medicine, not mushrooms. Read when psilocybin could be legal in Nevada.

Questions people ask
Are magic mushrooms decriminalized in Las Vegas?
No. Las Vegas, Henderson and North Las Vegas have no measure that decriminalizes or deprioritizes psilocybin, and state law applies everywhere in Nevada. Possession of any amount is a felony under NRS 453.336.
Do dispensaries in Las Vegas sell mushrooms?
Not psilocybin mushrooms. Nevada licenses dispensaries to sell cannabis, and no license covers psilocybin. "Mushroom" products in smoke shops aren't licensed psilocybin, and FDA testing has found Amanita compounds, unlisted synthetics and an undeclared prescription drug in some of them.
Is it legal to buy magic mushrooms online and have them shipped to Nevada?
No. Selling or shipping psilocybin is illegal under federal law and under Nevada law, and no state allows it by mail. Some online shops ship anyway; that doesn't make it legal for the seller or the buyer.
Can I take psilocybin legally in Colorado or Oregon and come back?
Adults 21 and over can take part in a licensed session under each state's rules: Oregon doesn't require residency, and Colorado's rules accept identification from any state. The psilocybin is taken on site, and none of it can be brought back to Nevada; that would be illegal transport under state and federal law.
Is Amanita muscaria legal in Nevada?
Amanita muscaria isn't on Nevada's or the federal controlled-substance schedules, but the FDA said in December 2024 that it, its extracts and three of its compounds aren't authorized as ingredients in conventional food, and it can cause poisoning. It isn't psilocybin. See our Amanita guide.
